es: En los últimos años, han tenido lugar una serie de cambios legislativos en todo el mundo encaminados a proteger la igualdad de los cónyuges. en este escenario, el código civil Brasileño de 2002, siguiendo una tendencia consagrada en la jurisprudencia, reconoció al cónyuge sobreviviente como heredero necesario, mientras que aseguró su derecho real a la habitación y a la partición de la herencia en la separación convencional del régimen de bienes. este artículo pretende analizar la evolución de la protección de activos del cónyuge sobreviviente según una redefinición cultural de la jurisprudencia del tribunal superior de justicia do Brasil.>>>en: En recent years, legislative changes have been occurring worldwide to protect equality between spouses. this article specifically takes into account the Brazilian civil code of 2002 which, following a trend established by the juris-prudence, admitted the surviving spouse as a legitimate heir, while guaranteeing his/her right to property and the division of inheritance within the conventional separation of property regime. this article seeks to analyze the evolution of the protection of a surviving spouse’s assets according to a cultural redefinition of the jurisprudence by the Superior Court of justice.>>>

en: This paper analyzes the requirements that must be present in the redhibitory vices in the contract of sale: serious, hidden and prior to the contract, as alleged in the redhibitory course of action and the action of price reduction according to its regulations in the chilean and colombian civil code. Based on a study of the rules, doctrine and jurisprudence from both countries and using elements of comparative law, the recurring problems that have arisen in cases decided by chilean and colombian courts are identified as well as the subject of doctrinal debate issues arising in connection with each of these requirements and proposed solutions.>>>

en: This paper analyzes to what extent it can be said that in the case of service contracts, the customer is entitled to specific performance in the case of a breach of contract under current spanish law. due to the existence of a right to specific or in natura performance and because of its “preferred” character, this remedy can –and should– be analyzed from two complementary, although differing perspectives: one is the substantive perspective and the other is the procedural perspective. this work addresses and develops both perspectives.>>>

en: In the late 1980s, ian Ayres and robert Gertner proposed a supplementary but controversial theory about how to fill gaps in incomplete contracts. specifically, the authors coined the concept of the “penalty default rule”. this is a default rule that penalizes the silence of the contracting parties by filling a gap with a term that the majority of parties wouldn’t have wanted. Based on this theoretical background, the aim of this paper is to show that indeed, there are penalty defaults rules in colombian contract law. to this end, the paper (i) proposes a methodology to identify hypothetical factual situations in which penalty defaults should be established; subsequently, (ii) this methodology is tested in light of the central example of “penalty default rules” described by ayres and Gertner; finally, (iii) the methodology is once again tested, but using an example of colombian contract law.>>>

en: This work aims to analyze the application of the original general action for contingent damages, which Andrés Bello contributed to in the Latin american codification process. this work specifically focuses on the chilean, colombian and ecuadorian model of liability based on the fact that they share the same general regulatory model: the chilean civil code (promulgated on december 14, 1855, and then adopted in Colombia and ecuador) through its consecration expressed in these countries, showing the status of their application and the dissimilar evolution among them.>>>

en: The procedure for the order for payment is a new tool in colombian legislation that stands as the most effective way of solving certain disputes ari-sing with creditors when they lack an enforceable title. thus, the legal system seeks to ensure effective protection of credit by ensuring a speedy and efficient administration of justice.the essential feature of this procedural institution is the overcoming of the burden of proof. here, the debtor (the defendant) states the reasons why it considers it has no duty. however, the legislature merely refers to an empty concept as it does not determine the scope of the duty or its foundation. this study seeks provide the interpreters of the law with tools to allow them to understand the opposition according to the principles of procedural Law.>>>

en: While the legal systems regulate the so-called ‘sex change’, the legal effects within the sphere of personal rights are not well known. thus, there are not always clear answers about the status of those rights whose ownership depends on the gender allocated to each person; for example, the rights arising from family relationships. in this context, based on the study of a recent italian court decision, a critical analysis is conducted on the effects of ‘sex change’ in an existing marriage, with particular regard to current regulations and some mention of the colombian model in order to determine whether the paradigm of heterosexual marriage persists.>>>
